Nairobi County government The City County Government of Nairobi has sued Kenya Power for threatening to disconnect power supply to key facilities in the city over an outstanding Ksh 732 million debt.
The county government argues that Constitution grants rights to healthcare to all persons and the threatened act by the power supplier violates the right to healthcare of many residents of the city.
The city county claims that the threatened action is in bad faith and meant to disrupt it’s activities.
“In order to safeguard the interest of the petitioner, the High Court should protect due process of law and avoid total service disruption and disorganization in the city to preserve the right to health and life of millions,” the county government stated.
The county government is apprehensive that should the court fail to intervene, members of public will suffer irreparable loss not capable of being compensated in damages.
It is further argued that disconnection of power supply to Primary and Nursery schools manned by petitioner is contrary to best interest of children.
